Scope
These Terms & Conditions apply to all purchases made through the Warm Wear Daily online store. They form part of the agreement between you and Warm Wear Daily, together with the information provided during checkout and your statutory consumer rights.
Orders & Contract
When you place an order, you submit a binding offer to purchase the items in your cart. The automatic order confirmation only confirms that we have received your order and does not by itself constitute acceptance. Unless otherwise expressly stated, the purchase contract is concluded when we send you a dispatch confirmation or dispatch the goods.
If an item is unavailable before we accept your order, we may decline the order and will refund any amount already paid for that item. If a purchase contract has already been concluded, your statutory rights remain unaffected.
Prices & Payment
The prices applicable to your order are those displayed in our store at the time you place your order. Any applicable shipping costs will be shown before you complete checkout.
Payment must be made using one of the payment methods available during checkout.
Product Availability
Product availability may change. If an item becomes unavailable after you place an order, we will contact you as soon as reasonably possible and refund any payment relating to the unavailable item if we are unable to fulfil the order.
Shipping & Delivery
Orders are shipped to the delivery address provided during checkout. Information about order preparation, delivery and shipping costs can be found on our Shipping & Delivery page.
Please make sure your delivery information is complete and accurate before submitting your order.
Right of Withdrawal & Returns
Consumers in the EU generally have a statutory right to withdraw from an online purchase within 14 days of receiving the goods, subject to applicable legal exceptions. Statutory consumer rights are not restricted by these Terms & Conditions.
Return Shipping Costs
Where permitted by law and where the customer has been informed accordingly, the customer is responsible for the direct cost of returning goods following a standard withdrawal. This does not affect rights relating to defective or incorrectly supplied goods.
Defective, Damaged or Incorrect Items
If an item arrives defective, damaged or different from what you ordered, please contact us with your order details and relevant photos where appropriate.
Your statutory rights relating to defective goods remain fully applicable. We will provide the remedy required under applicable law.
Product Information
We aim to present product descriptions, sizing, materials and images as accurately as possible.
Colors may appear slightly different depending on your device or screen settings. Minor visual differences that do not affect the agreed characteristics of the product do not limit your statutory rights.
Ownership
Goods remain the property of Warm Wear Daily until the purchase price has been paid in full.
Refunds
Refunds will be issued using the original payment method unless otherwise agreed where legally permitted.
Where permitted by law, reimbursement following a withdrawal may be withheld until we have received the returned goods or you have provided proof that the goods were sent back.
Liability
Our liability is governed by applicable law. Nothing in these Terms & Conditions excludes or limits liability or consumer rights where such exclusion or limitation is not legally permitted.
Governing Law
These Terms & Conditions are governed by German law. If you are a consumer residing in another country, this choice of law does not deprive you of mandatory consumer protections that apply in your country of residence.
